GRAD Raffle License

GAMING LICENSE RESTRICTIONS FOR RAFFLE TICKET SALES:

 

LICENSE B – PROCESS

PAC does not have a blanket license that other school groups can use.  To be specific, PAC BOARD MEMBERS (PAC EXECUTIVE, positions – CHAIR, TREASURER, DIRECTORS).  This license belongs to PAC only and only PAC can apply.  If someone other than the PAC Executive applies, this becomes a fraudulent offence.  IF it is necessary for GRAD to request to use PAC’s gaming license, they must be or become a PAC EXECUTIVE MEMBER.

Both the Parents Association and MESS Dry Grad have files with the Branch. It is very important which file the application is submitted under, because the licence will be issued under that file and that group is then named on the licence as the licensee. The licensee is responsible for the conduct and management of the gaming event, must deposit sales revenue appropriately, disburse the funds for eligible purposes in accordance with the Conditions, and submit the required Gaming Event Revenue Report.

So, if Grad wants to fund raise, they must apply for their OWN license as do other non-profit organizations.

IF Members of PAC are on the Executive and would like to be part of the GRAD fundraising process, the following applies:

Option 1 (greater degree):
The PAC applies for the licence under their own file and is the licensee. As the licensee the PAC is responsible for the conduct and management of the gaming event and must:
· Perform the duties outlined in section 2.2 of the Standard Procedures for Ticket Raffles (Standard Procedures).
· Deposit the sales revenue to the PAC’s Gaming Account per section 12 of the Guidelines: Applying for a Class A or Class B Gaming Event Licence (Guidelines), is responsible for collecting receipts and paying for  eligible expenses (such as raffle ticket printing, prizes, decorating, hall rental, etc) of the raffle from the Gaming Account, and retain all records as required.  The GRAD fundraising money cannot be just simply deposited in the PAC account and GIVEN to GRAD, THE GAMING APPLICATION, RECEIPTS, REIMBURSEMENT FOR ELIGIBLE RECEIPTS MUST BE ACCOUNTED FOR IN THE GAMING REPORT AND SUMMARY.  PAC is responsible for ALL THE REPORTING and to keep ALL RECORDS/RECEIPTS.
· Disburse the net proceeds for eligible purposes from the Gaming Account. While the PAC may earmark these funds for dry grad disbursements, the PAC may not simply donate the funds back to the dry grad group. Advances or donations of gaming funds are not permitted. However, the PAC may REIMBURSE the school, dry grad group, or individual for eligible disbursements provided supporting documentation is retained as part of the PAC’s gaming records, or the PAC may pay suppliers directly. The Branch prefers that the PAC pays suppliers directly whenever possible as this creates the shortest paper trail.
· Submit the required Gaming Event Revenue Report  within 90 days of event.
· Include the required information on the PACs annual Gaming Account Summary Report. FILL IN #7, PRIZE COSTS ON TOP OF PAGE 2 AND EXPENSES AS WELL AS DISBURSEMENTS ON SECTION 5

EXAMPLE of OPTION 1:

FOR REPORTING PURPOSES, AN EXAMPLE IS TO FOLLOW:

PAC makes $5000.00 (I say PAC as the license is under PAC so it is PAC Board members that are supposed to be involved in selling tickets and be present for the prizes draws).

FIGURES – $5000.00 (Deposit must occur immediately).  If any money is stolen or goes missing, PAC is responsible to pay expences.

PAC must reimburse the cost of the raffle expenses NOT GRAD so for example:

Tickets – $100.00 Pyramid Printers

Prize 1 – Toys R Us

Prize 2 – Sight & Sound

Prize 3 – Shell gas

The leftover funds must also be reimbursed by items to suppliers if need be, for example, rental, decorating supplies (individual?), etc.   WE NEED RECEIPTS FOR EVERYTHING!  Any profits leftover belong to PAC.

Option 2 (lesser degree):
MESS Dry Grad applies for the licence under their own file as a Community Fundraising Group per section 8.9 of the Guidelines, and is the licensee. As the licensee, MESS Dry Grad is responsible for the conduct and management of the gaming event and must:
· Include with their application a letter from the PAC per section 8.9 of the Guidelines. Last year’s letter is not acceptable, which was an oversight on our part.
· Perform the duties outlined in section 2.2 of the Standard Procedures.
· Deposit the sales revenue appropriately per section 12 of the Guidelines, pay eligible expenses of the raffle from that account, and retain all records as required.
· Donate the net proceeds to an eligible organization for disbursement for eligible purposes, in this case, the PAC.
· Submit the required Gaming Event Revenue Report.
Under this option, as the recipient of a donation of gaming funds the PAC must:
· Provide the licensee, MESS Dry Grad, with a letter that acknowledges the event, agrees to accept the proceeds and agrees to use them for eligible purposes. Last year’s letter is not acceptable, which was an oversight on our part.
· Disburse the net proceeds for eligible purposes. Again the PAC may not simply donate the funds back to the dry grad group. See above.
· Report the donation of gaming funds in section 3 of the Gaming Account Summary Report, bottom of page 1.

With regard to the outstanding reports, no we have not received those reports, but given how long ago they were due we’ve now given up on receiving them. They’ve been cancelled on the PAC’s file. This is a one-time exception.  Future consequences could result in PAC losing their licence or worst case scenario, affect their PAC gaming grant application.

 

CLASS D LICENSE – GRAD

As noted earlier generally a dry grad group is only eligible to apply for a Class D licence. FOR THE CLASS D, THE MAXIMUM AMOUNT THEY CAN SPEND ON PRIZES IS $500.00, TICKETS can be sold for $2.00 max. If the gaming event the dry grad group is planning does not fall within the parameters of a Class D licence, they have two options to apply for a Class A or B licenece, and both involve the PAC to a greater or lesser degree.  SEE ABOVE.
